Setback for Ex-Governor Waititu as High Court Rejects Bail Request.
The High Court has turned down former Kiambu Governor Ferdinand Waititu’s application for bail pending appeal, ruling that he failed to provide sufficient justification for his release.
Waititu had argued that his health condition warranted bail. However, in its Monday ruling, the court stated that prison facilities are adequately equipped with medical services and that inmates with serious conditions are referred to specialized hospitals for treatment.
The court further noted that bail is not granted automatically and that an applicant must prove their appeal is substantial and has a strong likelihood of success.
Additionally, the court dismissed Waititu’s concern that his appeal might take too long, affirming that the court’s schedule ensures the case will be heard and resolved within two months, given that the main appeal has already been filed. Instead, the court ordered the appeal to be prioritized.
Waititu is challenging last week’s lower court verdict, which sentenced him to 12 years in prison or a fine of Ksh.52.5 million over a Ksh.588 million corruption case.
